Terms of Service

1. Acceptance of Terms

By accessing or using InstaClaw ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

InstaClaw provides subscribers with a personal AI agent that InstaClaw provisions, operates, and maintains. Each subscriber receives a dedicated virtual machine with shell access, messaging integrations, and AI capabilities. The Service is provided on a subscription basis.

3. Accounts and Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service.

4. Billing and Payment

Subscriptions are billed monthly and renew automatically each month until you cancel. Your payment method will be charged automatically at the start of each monthly billing period. You may cancel at any time from the billing page. No refunds are provided for partial months.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, phishing, or other unsolicited messages
• Harass, threaten, or harm others
• Distribute malware or engage in unauthorized access of systems
• Generate content that exploits or harms minors
• Circumvent rate limits or abuse shared infrastructure

6. BYOK (Bring Your Own Key)

If you use BYOK mode, you are responsible for your own Anthropic API key usage and billing. InstaClaw is not responsible for charges incurred on your Anthropic account.

7. Improving InstaClaw for Everyone

7.1 What you let us use. Unless you turn it off in Settings, you grant InstaClaw a worldwide, non-exclusive, royalty-free license to use your conversations with your agent, and records of how the work your agent does for you turns out, to improve InstaClaw for everyone. That includes studying them to improve how every InstaClaw agent chooses and uses its models, tools and skills, and using your conversations to train, evaluate and improve AI models, including models that serve other customers. "Your conversations" means the messages you send your agent and the replies it sends you. "Records of how the work turns out" means what your agent did, which models, tools and skills it used, and whether the job got done, and not the words of your conversations. Neither includes your agent's files or its memory. This is on unless you turn it off.

7.2 Only from when you agree to it. This section applies only to what happens after you agree to these Terms with this section in them, and never to anything before. Continuing to use the Service does not count as agreeing to this section.

7.3 Turning it off. You can turn this off at any time in Settings. One setting covers everything in 7.1. From then on we will not use any of your conversations or records for the purposes in 7.1, including ones we collected while it was on but have not yet used. A model that has already been trained cannot forget what it learned, so turning this off does not change models trained before you did.

7.4 What we never use, whatever your setting. We never use for the purposes in 7.1 (a) your email, calendar, files, or any other account or app you connect to your agent, anything your agent saw on your screen, or any part of a conversation in which your agent read any of them; (b) conversations in private mode; (c) conversations your agent has through an AI account or key you connect yourself; (d) your agent's files or memory; (e) logins or other information you type while you control your agent's browser; (f) anything you have asked us to delete; (g) content from a program whose own terms promise you something narrower; or (h) anything from before you agreed to these Terms with this section in them.

7.5 Deletion. If you ask us to delete something, we stop using it for the purposes in 7.1 and delete it from any data we keep for those purposes within 30 days, except what the law requires us to keep. The limit in 7.3 on models already trained still applies.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We are not liable for downtime or data loss.

9. Termination

We reserve the right to suspend or terminate your account for violation of these terms. Upon cancellation or termination, your virtual machine and associated data will be deactivated and may be permanently deleted after 30 days.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind. InstaClaw shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

11. Text messages

Some parts of InstaClaw work by text message. What we send, how often, what it costs and how to stop it are set out in our SMS Terms, which apply to those messages wherever these terms and those terms speak to the same thing.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.

These terms are an agreement with Cooper Wrenn, doing business as InstaClaw, a sole proprietorship.
